Terms of Service.
Review the official policies, resource allocation rules, acceptable use standards, and service commitments governing Command Server Hosting and Aimless Creations.
Contracting Agreement
These Terms of Service constitute a legally binding agreement between you and Aimless Creations, operating under the commercial trade name Command Server Hosting (“CSH,” “Command Hosting,” “we,” “us,” or “our”), an unincorporated entity organized in Alabama, United States.
1. Acceptance, Contracting Parties, and Consumer Rights
01By registering, purchasing, or utilizing services from Command Server Hosting, you enter into a binding legal contract with Aimless Creations (trading as Command Server Hosting). If you do not agree to every provision in these Terms, you may not access or use our services.
Nothing in these Terms excludes, limits, or modifies any non-waivable statutory rights, guarantees, or remedies conferred by applicable consumer protection laws—including the EU Consumer Rights Directive (Directive 2011/83/EU), the UK Consumer Rights Act 2015, and the Australian Consumer Law (Competition and Consumer Act 2010)—that cannot be lawfully excluded by contract.
Age Eligibility
You must be at least thirteen (13) years old (or sixteen (16) where local law requires). Users between thirteen (13) and the age of legal majority represent that they have obtained the informed consent of a parent or legal guardian. CSH reserves the right to request proof of age or identity at any time.
2. Billing, Cancellations, and Refund Terms
022.1 Digital Fulfillment & Waiver of Withdrawal
You acknowledge and agree that service provisioning begins immediately upon payment confirmation. In accordance with Article 16(m) of EU Directive 2011/83/EU, Regulation 37 of the UK Consumer Contracts Regulations 2013, and related international regulations, you expressly waive your statutory 14-day right of withdrawal once provisioning begins.
2.2 Refund Policy & 72-Hour Evaluation Window
Because dedicated gaming infrastructure incurs upfront, unrecoverable bare-metal hardware and network costs from our upstream providers, all sales are final, subject only to non-waivable consumer laws. To prevent trial abuse, automated script scraping, and fraudulent server-hopping, refunds or cancellations are considered only if:
- The server instance has been provisioned for a minimum evaluation window of seventy-two (72) consecutive hours;
- The customer provides verified proof of chronic hardware downtime or non-delivery that breaches agreed specifications; and
- CSH technical support is given a reasonable opportunity to investigate and resolve the issue via an official ticket.
Where a discretionary refund or billing adjustment is granted by CSH, it will be issued exclusively as Account Credit applied to the user's billing account. No original-payment-method or cash refunds will be processed, unless explicitly mandated by statutory consumer protection laws.
2.4 Command Plus & Digital Add-ons
Subscriptions to Command Plus, custom installation services, priority support passes, and domain registrations are fully executed digital services delivered upon purchase and are strictly non-refundable.
2.5 Chargebacks, Payment Disputes, and Recovery
- Customers are encouraged to utilize CSH's administrative support ticketing process to resolve billing disputes. This process is intended to facilitate quick resolution and does not waive any statutory rights the customer may have to dispute a transaction with their financial institution.
- Initiating a payment dispute or chargeback without first completing the ticket resolution process entitles CSH to immediately suspend or terminate all services associated with the account to mitigate operational losses.
- In the event of an unjustified or fraudulent chargeback, the customer remains legally responsible for the outstanding balance, chargeback administration fees levied by payment processors, and all reasonable collection or legal costs incurred by CSH in recovering legitimate debts, to the fullest extent permitted by law and card network rules.
2.6 Price Changes
CSH reserves the right to adjust service pricing and resource allocations to reflect upstream infrastructure costs. Price adjustments will take effect on subsequent renewal cycles following at least thirty (30) days' advance notice via email or panel announcement.
3. Service Limitations, Upstream Infrastructure, and Fair Use
033.1 Dedicated Gaming Application Standard
Standard game server allocations are engineered and priced exclusively for running authorized dedicated game software (e.g., Minecraft, BeamMP, Garry's Mod, ARK). Using standard game hosting tiers to deploy general web servers, public API endpoints, Discord bots, standalone relational databases, media streaming relays, or general application containers is strictly prohibited.
CSH services are hosted on bare-metal and virtualized infrastructure leased from Contabo GmbH. You acknowledge that network routing, upstream data center maintenance, physical hardware availability, and IP range allocations are managed in coordination with Contabo GmbH. CSH is not responsible for upstream transit provider outages, fiber cuts, or facility maintenance conducted by Contabo.
3.3 "Unlimited" Resources & Fair Allocation Standard
Statements such as "Unlimited Storage" or "Unmetered Bandwidth" refer to unconstrained allocations for typical, good-faith game server operation. These allocations are neither infinite nor unbounded. Storage allocations are restricted exclusively to active game instances (world maps, executable plugins/mods, core game configurations, and operational logs). Using server allocations for personal cloud storage, bulk media libraries, video repositories, ISO distributions, external backup targets, or file-mirror nodes is strictly prohibited.
3.4 Fair Share Hardware Limits & Throttling
Multi-tenant host nodes operate on shared parent hardware. CSH actively monitors CPU core allocation, memory usage, thread counts, and storage I/O operations per second (IOPS). If an instance consumes resource levels disproportionate to baseline tier expectations—thereby degrading neighboring instances—CSH reserves the right to issue warnings, apply container CPU/IOPS limits, enforce database quotas, or require mandatory migration to an enterprise or dedicated tier.
3.5 DDoS Mitigation and Network Defense
In the event that a server instance becomes the target of a Distributed Denial of Service (DDoS) attack or network anomaly of sufficient magnitude or duration to threaten the operational stability of the host node or upstream transit provider, CSH reserves the unilateral right to filter, throttle, or null-route the target IP address immediately and without liability. Temporary null-routing deployed for infrastructure defense does not constitute compensable downtime.
4. Acceptable Use Policy and Prohibited Content
04CSH maintains a strict zero-tolerance enforcement stance regarding harmful, malicious, and illegal operations. The following activities will trigger immediate account termination, data eradication, and referral to relevant law enforcement bodies:
- Malicious Network Operations: Operating port scanners, vulnerability scanners, stress-testing utilities, botnet command-and-control daemons, malware payloads, ransomware distribution points, phishing sites, or amplification proxies.
- Cryptocurrency & Computing Abuse: Executing cryptocurrency mining algorithms, distributed computing grids (e.g., Folding@Home), or crypto node verifiers.
- Unlawful & Exploitative Content: Hosting, transmitting, or facilitating child sexual abuse material (CSAM), non-consensual imagery, terroristic communications, illegal weapons trafficking data, or stolen proprietary databases. CSH reports all verified CSAM material directly to the National Center for Missing & Exploited Children (NCMEC) and federal authorities.
- Proxy and Anonymization Networks: Operating public VPN servers, TOR exit/relay nodes, or open commercial proxies.
5. Intellectual Property, Third-Party Mods, and DMCA
055.1 Client Content Liability
You represent and warrant that you own or possess all requisite licenses, rights, and consents for all software, textures, assets, mods, scripts, and media files uploaded to CSH servers. You assume 100% legal and financial liability for content deployed under your account.
5.2 Unauthorized & Leaked Intellectual Property
The deployment of pirated, cracked, or unauthorized commercial modifications, assets, or software is strictly prohibited. Upon receipt of verified proof of unauthorized distribution from a copyright holder or developer, CSH reserves the right to purge the infringing files immediately without prior notice.
5.3 DMCA Notice and Takedown Procedure (17 U.S.C. Section 512)
CSH complies fully with the Digital Millennium Copyright Act. Formal notices of copyright infringement must be directed to our designated copyright agent:
Required Information: A physical/electronic signature of the authorized agent; identification of the copyrighted work claimed to be infringed; specific file paths or URLs; contact information; a good-faith statement of unauthorized use; and a statement under penalty of perjury that the notification is accurate.
5.4 Repeat Infringer Policy
CSH enforces a strict repeat-infringer policy. Accounts subject to multiple substantiated copyright takedown notices will be terminated permanently without refund.
6. Data Integrity, Backups, and Disclaimer of Data Loss
066.1 Client Backup Responsibility
You acknowledge that you retain sole responsibility for creating, verifying, and maintaining off-site backups of all server configurations, world maps, player data, and databases.
6.2 Nature of On-Platform Backups
Any automated backup utilities, snapshot functions, or cloud archive systems provided by CSH are provided strictly as secondary convenience features without service level guarantees.
6.3 Total Disclaimer of Data Liability
CSH and its infrastructure providers accept no liability, to the maximum extent permitted by applicable law (excluding gross negligence or willful misconduct), for corruption, loss, destruction, or unrecoverability of data resulting from hardware failure, storage drive degradation, filesystem corruption, software incompatibilities, malware, unannounced mod updates, or accidental administrative actions.
7. Support Scope and Anti-Harassment Standards
077.1 Support Boundaries
CSH technical support is strictly limited to host-level issues: node hardware operation, core network routing, operating system virtualization, billing management, and base control panel functionality. CSH staff is not obligated to write, configure, install, debug, or optimize third-party game modifications, server-side plugins, custom scripts, internal configuration files, or database schemas.
CSH maintains a zero-tolerance policy regarding abusive behavior toward staff. Any verbal abuse, harassment, profanity, discriminatory remarks, or personal threats directed toward CSH personnel will result in immediate termination of the support interaction, permanent revocation of ticket privileges, and, at CSH's discretion, summary cancellation of all active hosting services without refund.
8. Account Integrity and Sub-User Access
08Account holders are strictly prohibited from sharing primary master credentials (billing panel or root management panel passwords). To grant third parties administrative access to a game instance, you must utilize the integrated Sub-User delegation tool to configure restricted, unique credential profiles. The primary account owner remains fully responsible and legally liable for all actions, resource usage, and policy breaches committed by delegated sub-users.
9. Disclaimer of Warranties
09Except where prohibited by applicable consumer protection laws:
- The services, panels, infrastructure, and hardware are provided strictly on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, implied, statutory, or collateral.
- CSH expressly disclaims all implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted operation.
- CSH does not warrant that services will be error-free, that vulnerabilities will be remediated instantaneously, or that services will maintain 100% continuous uptime. Scheduled maintenance windows, emergency security patching, upstream transit provider cuts, and DDoS mitigation events do not constitute compensable service outages.
10. Limitation of Liability
10To the maximum extent permitted by applicable law:
- Under no legal theory—whether in contract, tort (including negligence), strict liability, or otherwise—shall CSH, Aimless Creations, their owners, officers, employees, or infrastructure suppliers (including Contabo GmbH) be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages. This includes damages for loss of profits, goodwill, data, gameplay progress, operational downtime, or business interruption, even if CSH was advised of the possibility of such damages.
- In all circumstances, CSH's cumulative aggregate financial liability arising out of or relating to these Terms or the services shall not exceed the total fees actually paid by you to CSH for the specific service instance at issue during the twelve (12) month period immediately preceding the event giving rise to liability.
11. Governing Law, Dispute Resolution, and Arbitration
1111.1 Governing Law
These Terms, and any dispute arising from or related to them, shall be governed by and construed under the laws of the State of Alabama, United States, without regard to conflict of law principles or the United Nations Convention on Contracts for the International Sale of Goods (CISG).
11.2 US Domestic Dispute Resolution & Mandatory Arbitration
For users residing in the United States, any dispute, controversy, or claim arising out of or relating to this contract, including its formation or breach, that cannot be resolved through informal negotiations within thirty (30) days shall be settled exclusively by final and binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules and Consumer Arbitration Rules. Arbitration hearings shall take place in Mobile County, Alabama, or virtually where agreed.
11.3 Class Action and Jury Waiver
You and CSH expressly agree that any claims must be brought solely in an individual capacity, and not as a plaintiff, class member, or representative in any purported class, collective, coordinated, or representative proceeding. You expressly waive any constitutional or statutory right to a trial before a jury.
If you are an individual consumer resident in the European Union, the United Kingdom, or another jurisdiction where mandatory consumer legislation prohibits binding pre-dispute arbitration agreements or mandatory foreign forum selection, this Section 11 shall not deprive you of the protection afforded by provisions that cannot be derogated from by agreement. In such cases, you may bring legal proceedings concerning these Terms in the competent courts of your country of residence.
12. Miscellaneous Provisions
1212.1 Force Majeure
Neither party shall be held liable for failure or delay in performance resulting from causes beyond reasonable control, including acts of God, war, terrorism, civil unrest, labor disputes, telecommunication carrier failures, fiber cuts, upstream provider outages (including Contabo facility disruptions), national or global internet outages, hardware supply-chain embargoes, power grid blackouts, or malicious cyberattacks (including volumetric DDoS events exceeding mitigation capacities).
12.2 Severability
If any provision of these Terms is determined by a court of competent jurisdiction to be unlawful, invalid, or unenforceable, that provision shall be severed or limited to the minimum extent necessary to comply with the law, and the remaining provisions of these Terms shall remain in full force, effect, and enforceability.
12.3 Corporate Successorship
In the event that Aimless Creations or Command Server Hosting reorganizes, converts, or registers into a Limited Liability Company (LLC) or corporate entity, this Agreement and all rights, licenses, and obligations herein shall automatically assign and transfer to the successor entity without requiring notice or re-execution.
12.4 Entire Agreement
These Terms, together with the Privacy Policy and any active service orders executed through our billing panel, constitute the complete and exclusive agreement between the parties concerning the subject matter herein.
